End User License Agreement

1. License Grant

Subject to your compliance with this End User License Agreement (“EULA”), the KamuSpec Terms of Service (“Terms”), and the Privacy Policy, Project2817, Inc. (“KamuSpec,” “we,” “us”) grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the KamuSpec mobile application (the “Mobile App”) on a mobile device that you own or control, solely for your personal or business use of the KamuSpec service in accordance with the Terms.

2. Restrictions

You will not, and will not permit any third party to:

• copy, modify, or create derivative works of the Mobile App;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, model weights, prompt templates, or any underlying ideas, algorithms, or trade secrets of the Mobile App, except to the extent applicable law expressly prohibits this restriction;
• rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Mobile App;
• remove, obscure, or alter any proprietary notice (including copyright, trademark, or watermark) contained in or displayed by the Mobile App;
• use the Mobile App to build, train, or improve a competing product or service, or to benchmark the Mobile App against a competing product;
• circumvent or attempt to circumvent any technical protection measure, license enforcement, or access control of the Mobile App.

3. App Store Terms

If you obtain the Mobile App through the Apple App Store, the Google Play Store, or any other mobile-application distribution platform (each, a “Store”), this EULA is between you and KamuSpec only, not with the Store. KamuSpec — not the Store — is solely responsible for the Mobile App and its content.

To the extent the Store’s terms (such as the Apple Media Services Terms and Conditions or Google Play’s Terms of Service) apply to your use of the Mobile App, those terms apply in addition to this EULA. If any term of this EULA conflicts with a Store term that the Store requires us to apply, the Store term controls only as to that conflict.

The Store has no obligation to provide maintenance or support for the Mobile App and is not responsible for product warranties, claims of non-conformance, or claims of intellectual-property infringement related to the Mobile App. Any such claim is solely the responsibility of KamuSpec.

4. Updates

We may release updates, patches, or new versions of the Mobile App. By using the Mobile App you consent to receive automatic updates as configured by your operating system or your device. We are not obligated to support older versions and may discontinue support at any time.

5. Termination

The license granted under §1 terminates automatically and without notice upon (i) termination of the Terms; (ii) your uninstallation of the Mobile App from all of your devices; or (iii) your breach of this EULA, the Terms, or the Privacy Policy. Upon termination, you must cease all use of the Mobile App and delete all copies. Sections 2, 6, 9, 10, and 11 survive termination.

6. Ownership

The Mobile App is licensed, not sold. KamuSpec and its licensors retain all right, title, and interest in and to the Mobile App, including all intellectual property rights. No rights are granted to you other than the limited license expressly stated in §1.

7. Open-Source Components

The Mobile App may include third-party open-source software components, each of which is licensed under its own license terms. Those terms govern your use of the corresponding components and are not superseded by this EULA. A current list of open-source attributions is available on request to support@kamuspec.com.

8. Export Controls

You represent that you (i) are not located in, or a resident of, any U.S.-embargoed or comprehensively sanctioned country or territory; (ii) are not on the U.S. Treasury OFAC Specially Designated Nationals List or any other applicable restricted-party list; and (iii) will not use the Mobile App in violation of U.S. export control laws.

9. U.S. Government End Users

The Mobile App is “commercial computer software” and the related documentation is “commercial computer software documentation,” each as those terms are used in 48 C.F.R. § 12.212 (FAR) and 48 C.F.R. § 227.7202 (DFARS). U.S. Government end users acquire the Mobile App and documentation only with the rights set forth in this EULA.

10. Incorporated Terms

Your use of the Mobile App is also governed by the KamuSpec Terms of Service and Privacy Policy, each of which is incorporated by reference. To the extent of any conflict between this EULA and the Terms with respect to your installation and use of the Mobile App as software (e.g., license grant, restrictions, App Store terms), this EULA controls; for all other matters, the Terms control.

11. Apple Third-Party Beneficiary

If you obtain the Mobile App through the Apple App Store, you acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
