Terms of Service

Last updated: April 26, 2026

The short version — please read. KamuSpec is a software tool that helps licensed home inspectors capture inspections and generate AI-drafted report narratives. The licensed inspector is the author of every final report and is solely responsible for its accuracy. AI output is a draft; you must verify it. Unlicensed users may use KamuSpec only for evaluation, and any evaluation output is watermarked and may not be sold or represented as a professional report.

Three things to know up front: (1) our liability to you is capped at the greater of what you paid us in the previous 12 months or $100; (2) disputes are resolved by binding individual arbitration in Harris County, Texas — no class actions, no juries; and (3) if you generate a report for a property you weren’t physically at, you fully indemnify us for any claim that follows.

This summary is a courtesy; the formal sections below are the controlling agreement. This document is not legal advice — for advice on how it applies to you, consult your own counsel.

1. Introduction & Acceptance

These Terms of Service (“Terms”) form a binding contract between you (“User,” “you”) and Project2817, Inc., a Texas corporation operating the KamuSpec product (“KamuSpec,” “we,” “us”).

The “Service” means our websites, our mobile applications, our cloud portal, our APIs, and any related software, content, or features we make available. By creating an account, by tapping “I agree,” or by otherwise accessing the Service, you accept these Terms, our Privacy Policy, and our End User License Agreement.

If you do not agree, do not access the Service. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

2. Eligibility — Dual-Use Model

You must be at least 18 years old and have legal capacity to enter into a contract. The Service operates under a two-mode model:

2.1 Production Mode (Licensed Use)

To use the Service to issue, sell, deliver, transmit to a real estate transaction party, or represent any Work Product as a professional home inspection report, you must be a Licensed Home Inspector in good standing with the Texas Real Estate Commission (“TREC”) — in any of its categories (Apprentice, Real Estate, Professional) — or a professional licensed by a comparable governmental or professional authority in another jurisdiction. You represent and warrant that you hold the necessary credentials for your intended use.

You agree to immediately notify KamuSpec and discontinue Production Mode use of the Service if your license is suspended, revoked, surrendered, expires, or otherwise lapses. Continued Production Mode use under a lapsed license is a material breach. Each time you initiate Production Mode you re-affirm that your license is in good standing.

Adjacent licensed professionals (Texas Professional Engineers, licensed real estate brokers, licensed pest operators, and equivalents) may use Production Mode only within the scope of their own licensure and only for outputs their license authorizes them to issue.

2.2 Evaluation Mode (Beta, Trial, Education)

Users without an active professional license may use the Service for evaluation, training, and testing purposes only. Evaluation Mode users are strictly forbidden from issuing, selling, transmitting, delivering, or representing any Work Product (in whole or in part) as an official or professional home inspection report. Violation is a material breach and triggers full indemnification under §13.

Inspection schools, training programs, and pre-license trainees may use Evaluation Mode for instructional purposes. A separate institutional addendum may govern that use. On the day you obtain a qualifying license, you may upgrade to Production Mode.

KamuSpec will programmatically watermark every Evaluation Mode Work Product with a non-removable banner reading substantially “EVALUATION USE ONLY — NOT A PROFESSIONAL INSPECTION REPORT.” You agree not to remove, obscure, alter, or attempt to circumvent the watermark. Any such attempt is a material breach and a fraud trigger.

Evaluation Mode is provided on a no-warranty basis and may be discontinued, gated, or restricted at any time without notice.

3. Account Security & One-Seat-Per-Human

You are responsible for the security of your credentials and for all activity under your account. Each user account is for one individual human; account sharing — including with employees, apprentices, or contractors — is prohibited. Team plans are available for multiple users.

Notify us immediately at support@kamuspec.com if you suspect unauthorized access. Until we receive that notice you remain responsible for activity under your credentials.

4. Inspector-in-the-Loop & AI Output Disclaimer

The Service generates Draft Narratives, not final findings. All AI-produced text, classifications, summaries, and inferences are advisory only and do not constitute a professional inspection opinion. The licensed user is the sole “Author” of any final Work Product and the sole bearer of professional responsibility under TREC’s Standards of Practice (or comparable rules in other jurisdictions).

Tapping “Approve & Save,” “Finalize,” or any equivalent affirmative action in the Service constitutes your electronic signature under the Texas Uniform Electronic Transactions Act (Tex. Bus. & Com. Code Ch. 322) and the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. §§ 7001 et seq.). Your sign-off legally binds you as the inspector of record for the approved content.

AI output may contain errors, omissions, or hallucinations. You are solely responsible for verifying every assertion in any draft against your own physical observation before approval. KAMU DISCLAIMS ANY WARRANTY THAT AI OUTPUT IS ACCURATE, COMPLETE, OR FIT FOR ANY PARTICULAR PROPERTY OR INSPECTION.

5. Acceptable Use Policy

You agree that you will not, and will not permit any other person to:

  • Physical Presence. Generate, approve, or transmit any inspection report for a property at which you were not personally and physically present at the time of the inspection events documented in the report (“pencil-whipping”).
  • Reverse engineering. Reverse engineer, decompile, disassemble, or attempt to derive the source code, model weights, prompt templates, or proprietary capture logic of any part of the Service, including without limitation Kamu Scan, Data Plate, DELTA-T (formerly Thermal), Drone, and Document capture modes.
  • Fabrication. Use the Service to fabricate, simulate, or stage observations, defects, or evidence of conditions you did not actually observe in the field.
  • Evaluation misrepresentation. If you are an Evaluation Mode user, issue, sell, deliver, transmit to a real estate transaction party, or represent any Work Product as an official or professional inspection report; or remove, obscure, alter, or attempt to circumvent the “EVALUATION USE ONLY” watermark.
  • Automation abuse. Operate scrapers, crawlers, scripts, or autonomous agents against the Service or its APIs except through KamuSpec’s officially supplied Mobile and Portal clients.
  • Resale. Resell, sublicense, white-label, or repackage the Service or any AI Output as the work product of a third party.
  • Account sharing. Share account credentials with any other person or use a single seat for the work of multiple humans.
  • Competitive benchmarking. Use the Service to generate comparative AI-vs-AI assessments or competitive product analyses without our prior written consent.
  • Legal violations. Use the Service in violation of TREC’s Standards of Practice, applicable state inspection rules, federal export controls, OFAC sanctions, or any other applicable law.
  • Harassment. Use the Service’s communication or sharing features to harass, threaten, or discriminate against any person.

We may suspend or terminate access for violation of this section at our discretion, with or without notice, and without refund. Suspension does not relieve you of accrued payment obligations.

6. Subscriptions, Billing & Refunds

Paid features of the Service are available through paid subscription tiers, the specifics of which are described on our pricing page (incorporated by reference). All fees are in U.S. dollars and are non-refundable except as expressly provided in this section or as required by law.

Auto-renewal. Subscriptions automatically renew at the then-current rate until canceled. You may cancel anytime through your account settings; cancellation takes effect at the end of the current billing period.

Refunds. Monthly subscriptions are not pro-rated. We will provide a full-month refund only on request within 14 days of your first paid signup. Annual plans are non-refundable after the trial-window refund period except where required by law.

Price changes. We may change subscription pricing on at least 30 days’ notice. Continued use of the Service after the effective date is acceptance of the new pricing.

Computational resources / fair use. High-volume processing — including sustained workloads that materially exceed reasonable per-seat usage — may be subject to soft caps, queue delays, or a requirement that you upgrade to a higher tier. We will give reasonable notice before enforcing a cap that would interrupt your workflow.

Suspension for non-payment. If a payment is past due, we may convert your account to read-only access after 7 days, and we may delete your data after 60 days delinquent (with at least 14 days’ final notice).

7. Data Retention & TREC Compliance

TREC requires licensed home inspectors to maintain inspection records for a minimum of four (4) years. We provide cloud storage of your inspection content as a convenience backup, not a regulatory archive of record. The licensed user remains solely responsible for maintaining their own permanent archive sufficient to satisfy TREC’s record-keeping obligations and any other applicable law.

KamuSpec makes no representation that data stored in our systems will remain available for the full TREC retention period or any other specific duration. You should periodically export your records to your own permanent storage.

During an active subscription you may export your data at any time through the Portal. After your subscription ends we retain your data for a 30-day grace period to allow export, then permanently delete it (subject to legal hold and routine backup-rotation retention as described in our Privacy Policy).

8. Intellectual Property & Data License

Your Work Product. As between you and KamuSpec, you own the final inspection report PDFs you generate and approve through the Service.

Our Service. KamuSpec owns the Service, all software, prompt templates, model selection logic, “Forensic” layout structures, capture-mode technologies (including Kamu Scan, Data Plate, DELTA-T (formerly Thermal), Drone, and Document), the KamuSpec wordmark, and all derivative works of the foregoing. Nothing in these Terms transfers any of those rights to you.

Data license to KamuSpec. You grant KamuSpec a worldwide, royalty-free, sublicensable license to host, store, transmit, copy, reformat, and process the photos, videos, voice notes, annotations, and metadata you submit through the Service, solely (i) to operate, maintain, and improve the Service for you, and (ii) in de-identified, aggregated form, to improve the accuracy, prompt design, and feature performance of the Service. We do not use your customer-identifiable inspection content to train foundational AI models.

Feedback. Any feature suggestions, bug reports, or other feedback you provide is granted to KamuSpec on a non-confidential basis and may be used freely without obligation to you.

Trademarks. “KamuSpec,” “Kamu Scan,” and the KamuSpec wordmark are our trademarks. You may attribute reports generated by the Service in factual terms (e.g., “report generated using KamuSpec”) but you receive no other trademark license.

9. Beta & Preview Features

Features identified as “Beta,” “Preview,” “Early Access,” or similar are provided as-is and without any warranty, may be modified or withdrawn at any time, and are excluded from any service-level commitments. Use beta features at your own discretion.

10. Third-Party Services

The Service relies on third-party infrastructure, identity, AI / Large Language Model, payment, and communication providers — including but not limited to Microsoft Azure (cloud storage), Clerk, Inc. (identity and authentication), Google, Anthropic, and OpenAI (AI synthesis of draft narratives), Apple and Google (authentication providers and app distribution), and various email and SMS providers. The current canonical list of sub-processors is maintained at kamuspec.com/legal/subprocessors and is updated as providers are added, changed, or removed.

KamuSpec is not liable for outages, errors, or policy decisions of those providers. Your use of any third-party service through the Service is subject to that provider’s own terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAMU DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, UPTIME, AND ERROR-FREE OPERATION.

KamuSpec is a software company. We are not a structural engineering firm, a licensed home inspection entity, an insurance carrier, or a law firm. Nothing produced by the Service is, and nothing in these Terms creates, professional engineering, inspection, insurance, or legal advice from us to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAMU’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, STATUTE, OR OTHERWISE), WILL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES YOU PAID TO KAMU IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

KAMU WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR LOST-PROFITS DAMAGES, EVEN IF KAMU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The cap above does not apply to (a) your obligation to pay fees due, (b) your indemnification obligations under §13, (c) your infringement of KamuSpec’s intellectual property rights, or (d) your breach of confidentiality obligations — for which KamuSpec’s recovery is not capped by this section.

E&O / Reports. You acknowledge that KamuSpec is not the inspector of record and is not insured under your errors-and-omissions policy. Any claim arising from a missed defect, an erroneous AI-drafted narrative you approved, or any other inspection deficiency is solely your responsibility.

Third-party data shield. You acknowledge that automated property data, weather conditions, square footage, parcel data, GIS information, and other site context provided by the Service are sourced from third-party databases (including but not limited to county appraisal districts, weather APIs, and mapping services) and must be independently verified by you for accuracy before incorporation into any approved report. KamuSpec makes no representation that such third-party data is current, complete, or correct.

13. Indemnification

13.1 General Indemnification by User

You will indemnify, defend, and hold harmless KamuSpec, its officers, directors, employees, contractors, and agents from and against any third-party claim, suit, demand, settlement, judgment, regulatory action, or related cost (including reasonable attorneys’ fees) arising out of or related to: (i) your inspections or reports; (ii) your violation of TREC’s Standards of Practice or any other applicable law; (iii) your breach of these Terms; (iv) your misuse of AI Output; or (v) your reliance on third-party-sourced property, weather, or site data without independent verification.

13.2 Physical Presence Indemnity (No Blame the Tool)

You agree to fully indemnify, defend, and hold harmless KamuSpec from any third-party claim, suit, demand, settlement, judgment, or regulatory action — including but not limited to claims for property damage, personal injury, or wrongful death — arising in whole or in part from your violation of the Physical Presence requirement in §5, including but not limited to generating, approving, or transmitting any inspection report for a property at which you were not personally and physically present at the time of the inspection events documented therein.

13.3 Evaluation Misrepresentation Indemnity

You agree to fully indemnify, defend, and hold harmless KamuSpec from any third-party claim arising in whole or in part from your representation, transmission, sale, or delivery of Evaluation Mode Work Product as an official or professional home inspection report, or from any attempt by you to remove, obscure, or alter the Evaluation Mode watermark.

13.4 Indemnification by KamuSpec (Limited)

KamuSpec will defend you against any third-party claim that the Service, used in compliance with these Terms, infringes that third party’s U.S. intellectual property rights, and will pay damages finally awarded or agreed in settlement. KamuSpec’s indemnification obligation under this §13.4 is capped at the total fees you paid KamuSpec in the prior 12 months and does not extend to claims arising from (a) your modifications to the Service, (b) AI Output you approved, (c) your content, or (d) combinations of the Service with anything KamuSpec did not provide.

14. Term & Termination

These Terms apply for as long as you access the Service. Either party may terminate for the other’s material breach with 30 days’ written notice and an opportunity to cure during that period. KamuSpec may terminate immediately, without notice, for: (i) violation of the Acceptable Use Policy in §5; (ii) non-payment beyond the periods in §6; (iii) loss of professional license by a Production Mode user; or (iv) a credible fraud or safety concern.

Sections that by their nature should survive termination — including §§ 4 (Inspector-in-the- Loop sign-off liability), 7 (Data Retention), 8 (IP & Data License), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Dispute Resolution), 16 (Governing Law), 20 (Notices), and 22 (General) — survive any termination.

15. Dispute Resolution — Binding Arbitration

PLEASE READ CAREFULLY. THIS SECTION REQUIRES YOU TO RESOLVE DISPUTES WITH KAMU BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including their existence, validity, interpretation, performance, breach, or termination, will be finally resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The seat of arbitration is Harris County, Texas. The arbitrator’s award may be entered in any court of competent jurisdiction.

Class action waiver. You and KamuSpec each agree that disputes will be resolved only on an individual basis and not as a class, collective, mass, consolidated, or representative proceeding. The arbitrator has no authority to consolidate or aggregate claims.

Jury trial waiver. To the extent any claim escapes arbitration, each party waives any right to a jury trial.

Carve-outs. Either party may bring an action in Harris County District Court for injunctive or equitable relief to address (a) misuse or infringement of intellectual property, (b) breach of confidentiality, or (c) Acceptable Use Policy violations causing irreparable harm. Either party may also bring a qualifying claim in small-claims court.

One-year limitation. Any claim arising out of or related to these Terms or the Service must be brought within one (1) year after the cause of action accrues, or it is permanently barred. This shortens the default Texas statute of limitations and is enforceable by your express agreement.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any action that is not subject to arbitration under §15 is the state and federal courts located in Harris County, Texas, and each party consents to the personal jurisdiction of those courts.

17. Modifications to These Terms

We may revise these Terms from time to time. For material changes we will give at least 30 days’ notice by email to the address on file or by an in-app banner. Continued use of the Service after the effective date is acceptance of the revised Terms. If you do not agree to a material change, your sole remedy is to stop using the Service before the effective date.

18. DMCA / Copyright Policy

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent at support@kamuspec.com (subject line: “DMCA Notice”). Include: (1) a physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material with URL or location; (4) your contact information; (5) a statement of good-faith belief; and (6) a statement under penalty of perjury that you are authorized.

We may remove allegedly infringing material and may terminate the accounts of repeat infringers. Counter-notices may be submitted to the same contact.

19. Export Controls & Sanctions

You represent that you (i) are not located in, or a resident of, any U.S.-embargoed or comprehensively sanctioned country or territory; (ii) are not on the U.S. Treasury OFAC Specially Designated Nationals List or any other applicable restricted-party list; and (iii) will not use the Service in violation of U.S. export control laws.

20. Electronic Signature & Notices

You consent to receive communications from KamuSpec electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. Your tap-to-accept or click-to-accept of these Terms, the EULA, or the Privacy Policy constitutes your electronic signature under the Texas UETA and federal ESIGN Act.

Email: support@kamuspec.com

Notices to you may be sent to the email address on file for your account; an email so sent is deemed delivered when sent.

21. Force Majeure

Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network outages, third-party-cloud-provider failures, or other utility failures.

22. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, the EULA, and any pricing or order documents, are the entire agreement between you and KamuSpec regarding the Service and supersede all prior or contemporaneous communications.

Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No Waiver. A failure or delay by either party to enforce any provision is not a waiver of that or any other provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, sale of assets, or similar corporate transaction.

Independent Contractor. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and KamuSpec. Neither party has authority to bind the other.
